Aadhaar Card Link with Income Tax Returns

The Government of India has mandated the linking of Aadhaar Card with PAN Card for filing Income Tax Returns. However, as per the Aadhaar Act, 2016 and section 139AA of the Income Tax Act, this requirement does not apply to individuals who are non-residents of India.

Exemption from PAN and Aadhaar Linking

Linking Aadhaar with PAN is compulsory only for eligible individuals. Exemptions from this requirement include:

  1. NRIs, OCIs, POIs, etc., who conduct business in India but do not reside here, are not required to link their PAN with Aadhaar.
  1. Foreign nationals residing in India are also exempt from the mandatory linking of Aadhaar with PAN.
  1. Taxpayers from Assam, Meghalaya, and J&K are exempted from linking their PAN with Aadhaar.
  1. Senior citizens aged above 80 years are not obligated to link both documents.
Link Aadhaar with ITR

With that in mind, the following Procedure is to be followed to link Aadhaar to ITR

Step 1 - Visit the official Income Tax portal for e-filing at incometaxindiaefiling.gov.in

Step 2 - Under the 'Quick Links' section, select 'Link Aadhaar.'

Step 3 - You will then be directed to the 'Link Aadhaar' page.

Step 4 - There you need to fill in the following fields correctly:
a. PAN
b. Aadhaar Number
c. Name, as per the Aadhaar card
d. Captcha Code

Step 5 -  After you have entered the aforementioned details correctly, click on 'Link Aadhaar' link at the end of the page to complete the process.

The steps to link Aadhaar and PAN by SMS are given below:

Type UIDPAN <space> <12 Digit Aadhaar Number> <space> <10 Digit PAN Number> and send the message to either 567678 or 56161.

For instance, if your Aadhaar number is 987654321074 and PAN number is ABCDE9565G, the message format would be UIDPAN 987654321074 ABCDE9565G. Send this message to 567678 or 56161.

How to Check Status of Aadhaar Link Request

After you have submitted the request to link your Aadhaar number to income tax returns, you can follow the following steps to check the status of the same:

Step 1 -  Under the ‘Quick Link’ click on 'Link Aadhaar Status' page

Step 2 - You can check the status by entering the following details:
a. PAN
b. Aadhaar Number 

Step 3 - After entering these details, click on 'View Aadhaar Link Status.'

Step 4 - You can now view the status of your Aadhaar link request.

Steps to Rectify Issues Linking PAN with Aadhaar

The primary issue encountered in linking PAN and Aadhaar cards often arises from discrepancies in name spelling, gender, or date of birth. These errors can stem from various sources, such as inaccuracies in document updates or human mistakes, potentially complicating the linking process. Rectifying these details is essential before proceeding with the linking process. Separate methods exist for updating PAN and Aadhaar details.

How to Correct Errors on Your PAN Card

To correct PAN Card details, follow these steps:

  1. Visit the official NSDL E-Governance website at www.tin-nsdl.com.
  1. Navigate to the "PAN" section under services.
  1. Select the "Apply" option within the "Change/Correction in PAN Data" category.
  1. From the "Application Type" dropdown menu, choose "Changes or Correction in existing PAN data/Reprint of PAN Card (No changes in Existing PAN Data)."
  1. Select the appropriate category of the assessee (e.g., "Individual" for PAN registered in your name).
  1. Provide necessary details such as name, date of birth, email address, and mobile number.
  1. Complete the Captcha and click "Submit."
  1. Upon submission, a Token Number will be sent to the registered email ID.
  1. Proceed by selecting the option to "Submit scanned images through e-Sign on NSDL e-gov."
  1. Enter additional details like father’s name, mother’s name (optional), and Aadhaar number.
  1. Update your address if necessary.
  1. Upload essential documents such as proof of address, age, identity, and PAN.
  1. Sign the declaration and click "Submit."
  1. Proceed to make payment through demand draft, net banking, or Credit/Debit card.

Upon successful payment, an acknowledgment slip will be generated. Print it and send it to the NSDL e-gov office along with physical proof of documents. Affix a photograph and sign across it. Write "Application for PAN Change" on the envelope along with the acknowledgment number and mail it to:

PAN Correction Costs: Know Before You Change

Updating your PAN Card details comes with a fee, depending on where you live:

  1. Domestic update (India): Rs.110 (includes processing fee and GST).
  1. International update: Rs.1020 (includes processing fee, dispatch charges, and GST).
