How to transfer vehicle ownership?

In certain situations, transfer of vehicle ownership is unavoidable. There are different situations under which transfer of ownership of the vehicle can be done. The government has made available the facility of transfer of ownership of a motor vehicle through a set procedure. There are certain specific documents that need to be submitted in order for the ownership transfer process to be complete.

Different situations under which transfer of vehicle ownership can take place

  • Transfer of ownership of a vehicle due to a normal sale:

    When a vehicle is purchased from its already existing owner, transfer of ownership of the vehicle has to take place in the name of the purchaser. The documents to be submitted to facilitate the transfer are:
  1. Original registration certificate of the vehicle in question.
  2. Form 29 with all the details complete in addition to a duplicate copy that is attested.
  3. Form 29 is a notice for the transfer of ownership of the motor vehicle.
  4. The details in the form to be filled include information about the seller and purchaser of the vehicle.
  5. Form 30 duly filled with all the information required in addition to a copy.
  6. Form 30 provides the details about the hypothecation/hire-purchase/lease agreement that the vehicle is under.
  7. A copy of the certificate of insurance of the vehicle which should be attested.
  8. A copy of the address proof of the person who has purchased the vehicle. It should also be attested.
  9. A certificate stating that the pollution emitted by the vehicle is under control and its attested copy.
  10. A receipt of the payment of the fee that was levied for the transfer of ownership.
  11. PAN card copy which should be attested in addition to Form 60 and Form 61.
  • Transfer of ownership in case the owner of the vehicle is deceased:

    If the owner of the vehicle is deceased, the legal heir of the deceased owner who is primed to take over the possession of the vehicle in question has to produce the following documents:
  1. Original registration certificate of the vehicle in question.
  2. If the vehicle is under some sort of hypothecation/hire-purchase/lease agreement, Form 30 and Form 31 in addition to the No Objection Certificate (NOC) from the financier.
  3. Certificate of survival or succession issued by the authority responsible.
  4. An affidavit has to be submitted by the applicant stating that the vehicle is to be named in his or her name and a written statement included which says that all the legal heirs of the deceased owner are willing to let the vehicle be registered in the name of the applicant.
  5. A copy of the certificate of insurance of the vehicle which should be attested.
  6. A copy of the address proof of the person who has purchased the vehicle. It should also be attested.
  7. A certificate stating that the pollution emitted by the vehicle is under control and its attested copy.
  8. A valid attested copy of the PUCC also needs to be submitted by the applicant.
  9. PAN card copy which should be attested in addition to Form 60 and Form 61.
  10. Form 20 also is to be duly filled and submitted by the applicant. It is required for the verification of the vehicle.

In case of a commercial vehicle, the documents mentioned below also need to be submitted along with the mandatory documents that have been mentioned above:

  1. The permit surrender slip.
  2. The applicant also needs to obtain the challan clearance from the traffic department.
  3. Certificate of tax clearance from the authority responsible.
  4. A valid certificate of fitness from the responsible authority.
