    The Chhattisgarh Government has already laid the groundwork for implementing the Real Estate (Regulation and Development) Act, 2016 in the state. Real Estate Regulatory Authority (RERA) will be set up by the State Government and a website for the same is expected to go live soon.

    As per the Act, the rules for real estate developers and agents in the state have been published and they are required by law to follow them. Some of the important rules of the Act for developers and agents have been mentioned below.

    RERA Chhattisgarh Real Estate Project Registration

    Any promoter in the state who are looking to start a new real estate project or is already working on one needs to register the same with RERA Chhattisgarh. As per the Real Estate Act, 2016, promoters are required to provide the following information with the relevant documents:

    • Duly filled ‘Form A’
    • PAN card and Aadhaar number of the promoter
    • Financial documents such as audited balance sheet, profit & loss statement, income tax returns for the last three years, et cetera
    • Details of the previous projects, if any
    • Information about the real estate project comprising compliance and registration certificates, details of apartments and garage, number of open parking areas, location information such as total area, latitude and longitude of the start and end points, development plans, a detailed note on amenities provided, encumbrance details of the land, project schedule, a copy of the legal title deed, et cetera
    • List of all the agents and consultants involved in the project, and the relevant information about the same

    RERA Chhattisgarh Real Estate Agent Registration

    Similar to the developers, real estate agents too, need to register with RERA Chhattisgarh. However, they are required to furnish only the following documents:

    • Duly filled ‘Form G’
    • PAN card
    • Income tax returns for the last three financial years
    • Enterprise information, including the name, contact details, address proof, partnership details, et cetera
    • Passport size photographs
    • Any other information or documents, as specified under the Act

    RERA Chhattisgarh Fees

    A registration fee will be levied on all applications submitted to RERA Chhattisgarh.

    For real estate developers, the registration fee depends on the type of the project and the area, as mentioned below.

    • If the area of the proposed project does not exceed 1,000 square metres, then the fee will be Rs.5 per square metre.
    • If the area is more than 1,000 square metres, then the fee will be Rs.10 per square metre. This is applicable if the project is related to housing
    • For commercial projects, a registration fee of Rs.20 per metre will be levied if the area of the proposed land is not more than 1,000 square metres. If the area is more than the mentioned limit, then the registration fee to be paid is Rs. 25 per square metre
    • If the project comprises commercial and residential units, then the registration fee charged will be Rs.10 per square metre, if the area is less than 1,000 square metre. If the area exceeds 1,000 square metre, then the fee for the same will be Rs.15 per square metre

    For real estate agents, the fees to be paid are as following:

    • If the applicant is an individual, then he/she needs to pay Rs.10,000 and the renewal fee for the same is Rs.5,000
    • If the applicant is not an individual, that is, it is an entity, then the registration fee to be paid is Rs.50,000. The renewal fee, in this case, is Rs.25,000

    For those who are looking to file a complaint with RERA, the following are the fees to be considered:

    • Rs.1,000, if the complaint is being filed with the Regulatory Authority and/or Adjudicating Officer
    • If an appeal is being filed with the Appellate Tribunal, then the fee to be paid for the same is Rs.5,000
